05: Redundancy dismissal
A redundancy is where the employer ceases or intends to cease carrying out the business, or where the requirements of the business have ceased or diminished. A dismissal for redundancy can fall within the definition of a fair dismissal, but gives the employee an entitlement to redundancy compensation, provided that the eligibility conditions are met (see below). For a redundancy to amount to a fair dismissal, it should be made on the basis of a non-discriminatory selection procedure, and there should have been consultation either with the individual employee or with employee representatives – dependent on how many redundancies have been proposed.Last Updated
