03: Direct discrimination
An individual can make a claim based on direct discrimination if treated less favourably on any of the grounds listed on the previous page. For example, if an individual is not promoted while someone of the opposite sex or of a difference racial origin is, this could be the basis of a direct discrimination claim which the employer would have to defend and to prove that the difference in treatment was not on discriminatory grounds. The only circumstance where direct discrimination is permitted is where the job comes within a limited ‘genuine occupational’ category where, for reasons of authenticity, as in the entertainment industry, or for reasons of privacy or decency, the employee should be of a particular sex or race.Last Updated
